1. Acceptance of Terms

By accessing, viewing, or downloading images from your online client gallery ("Gallery"), hosted through Pixieset's Client Gallery feature, you ("Client," "you") agree to be bound by these Terms of Service ("Terms"). These Terms apply in addition to any separate photography contract or agreement you have signed with Juan Reyes Photography ("Photographer," "we," "us"). If there is a conflict between this document and your signed contract, the signed contract controls.

2. Definitions

  • Gallery: the private online collection where your photos are delivered and hosted via Pixieset.

  • High-Resolution Images: final, edited JPEG files delivered for download and printing.

  • RAW/Source Files: unprocessed camera files (e.g., CR2, NEF, ARW) and any unedited, unretouched, or in-progress working files.

3. Gallery Access Period

  • Your Gallery link is delivered upon completion of editing and is active for 30 calendar days from the delivery date.

  • During this period, you may view, download or order prints of your High-Resolution Images as many times as needed.

  • You are responsible for downloading and backing up your own copies of all images before the 30-day period ends. We recommend saving files to at least two separate locations (e.g., a computer and a cloud backup).

  • After 30 days, the Gallery is automatically archived and download links are deactivated.

4. Archived Gallery Reactivation

  • Once archived, you may request that your Gallery be reactivated for a 48-hour window to allow additional downloads.

  • To request reactivation, contact us at contact@juanreyesphotography.com with your name, event information, and Gallery name/link.

  • Reactivation requests are typically processed within 1 business days — this is not instant, so please plan ahead if you have a deadline.

  • Reactivation is provided free of charge for the first request; a fee of $50 applies to subsequent requests.

  • At the end of the 48-hour window, the Gallery automatically re-archives.

5. Image Files & Downloads

  • The Gallery includes High-Resolution, print-ready JPEG images only.

  • RAW/source files and unedited images are not included under any circumstance. These are considered proprietary working files of the Photographer and are not available for purchase, download, or transfer.

6. Copyright & Ownership

The Photographer retains full copyright and ownership of all images in the Gallery, as provided under U.S. Copyright Act. Purchasing or downloading images grants you a limited personal-use license as described below — it does not transfer copyright or ownership of the images to you.

7. Permitted Use License

You may:

  • Print images for personal use.

  • Share images on personal (non-commercial) social media accounts, with photographer credit/tag appreciated.

  • Use images in personal photo books, frames, and albums.

You may not, without prior written permission:

  • Use images for any commercial purpose (advertising, marketing, resale, business use, etc.).

  • Submit images to publications, contests, or third-party galleries.

  • Alter, crop, filter, add text to, or apply presets/AI editing to the images.

  • Remove any watermark, if present.

  • Claim authorship of the images.

8. Printing & Reproduction

We recommend ordering prints through the Pixieset print store or a professional photo lab to preserve color accuracy and print quality. We are not responsible for color shifts, cropping issues, or quality problems that result from printing through drugstore kiosks, big-box retailers, or other non-professional labs.

9. Portfolio & Marketing Use

The Photographer reserves the right to use images from your session for portfolio display, the Photographer's website, social media, and marketing materials, unless you opt out in writing prior to your session or gallery delivery.

10. Third-Party Platform Disclaimer

Your Gallery is hosted using Pixieset, a third-party platform. While we take reasonable care in selecting our tools, we are not responsible for outages, bugs, data loss, or security incidents caused by Pixieset or any third-party service provider outside our reasonable control. This is another reason we strongly encourage downloading and backing up your files during the active access window.

11. Data Retention & Deletion

If no reactivation is requested within 3 years, Galleries and all associated image files will be permanently deleted from our systems, and cannot be recovered after that point. If a reactivation is used, the same deletion timeline applies 3 years after the 48-hour window closes.

12. Client Responsibilities

  • Keep your Gallery link and password (if provided) confidential; you are responsible for activity that occurs through shared access.

  • Provide accurate, up-to-date contact information so we can reach you about your Gallery.

  • Download your files within the active access period(s) described above.

13. Fees & Payment

  • Reactivation fee: $50

  • Rush reactivation (if processed faster than standard turnaround): $80

  • Any outstanding balance on your account must be paid in full before Gallery access or reactivation will be granted.

14. Limitation of Liability

To the fullest extent permitted by law, the Photographer's total liability arising out of your Gallery or these Terms is limited to the amount you paid for photography services. The Photographer is not liable for indirect, incidental, or consequential damages, including lost images due to failure to download within the access period.

15. Force Majeure

The Photographer is not responsible for delays or failures in Gallery delivery, access, or reactivation caused by circumstances beyond our reasonable control, including platform outages, natural disasters, or other unforeseeable events.

16. Privacy

Your personal information (name, email, contact details) is used only to deliver and manage your Gallery and to communicate with you about your order. See our full Privacy Policy for more detail.

17. Amendments

We may update these Terms from time to time. Changes will be posted with an updated "Last Updated" date. Material changes affecting an active Gallery will be communicated to you directly.

18. Governing Law

These Terms are governed by the laws of New York, without regard to conflict-of-law principles.

19. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Together with any signed photography contract, these Terms represent the entire agreement between you and the Photographer regarding your Gallery.
